Terms and Conditions | Locksmith 24x7
Retention of title
Locksmith 24x7 retains ownership of all delivered materials and goods until the customer has paid for them in full. Nevertheless, from the moment the goods are made available, the customer bears full responsibility for everything they have purchased, received, or had installed. This moment begins as soon as the goods leave the premises, storage areas, or workshops of Locksmith 24x7.
Without written permission from Slotenmaker 24×7, the customer may not sell, pledge, or otherwise transfer the delivered goods to others. In case of late payment, the customer must return the goods to Slotenmaker 24×7 upon first request. For returned goods, the customer will receive compensation based on the market value at that time or on what Slotenmaker 24×7 receives upon resale.
Payment Obligation & Payment Term
Unless otherwise agreed, the customer must pay in cash or by debit card immediately upon delivery. For invoice payments, a 14-day term applies. If the customer does not pay the full amount within this period, a €25 administration fee will be charged, plus any additional costs such as postage for payment reminders.
If the payment obligation is not met within 14 days of the invoice date, the customer must pay interest on the outstanding amount equal to the statutory commercial interest, with any part of a month counting as a full month.
All costs incurred by Slotenmaker 24×7, such as legal fees, extrajudicial and judicial collection costs – including amounts not awarded by the court – shall be borne by the customer, unless Slotenmaker 24×7 is ordered by the court as the losing party to pay court costs.
Extrajudicial costs amount to at least 10% of the invoice amount, with a minimum of €150. Complaints regarding the invoice amount do not suspend the obligation to pay.
The customer pays Slotenmaker 24×7 without discounts or set-offs, except for advances paid specifically for the agreement.
Once the customer fails to meet their payment obligations or otherwise defaults, they may no longer use the delivered results, unless the defect is of minor significance in relation to the entire agreement.
In the event of liquidation, bankruptcy, seizure, or a customer payment deferral, Slotenmaker 24×7's claims become immediately due and payable.
In case of non-payment, the customer grants Slotenmaker 24×7 permission to enter the location where Slotenmaker 24×7's property (such as tools, materials, or goods) is located to repossess it, without this reducing the customer's payment obligation.
14 days after the invoice date, the customer is automatically in default and owes statutory interest on the outstanding amount.
If the customer does not pay or if there is serious doubt about their creditworthiness, Slotenmaker 24x7 may suspend further deliveries until the amount due, including interest, has been paid and the customer has provided sufficient security for ongoing agreements. The customer is in default by the mere fact of non-performance, without the need for a reminder.
Liability
Locksmith 24/7 is not liable for:
a) Errors in materials provided by the customer.
b) Misunderstandings or problems with the execution of the agreement due to the client, such as late or incomplete submission of data or non-availability of work locations.
c) Third-party errors enabled by or on behalf of the customer.
d) Deficiencies in supplier bids or overruns on their price quotes.
e) Design defects, material defects, or poor quality of materials not supplied by Slotenmaker 24×7 but essential for the assignment.
f) Defects or problems that Locksmith 24×7 could not reasonably have known or controlled.
g) Negligence of the client to report important issues or defects that Locksmith 24x7 should have known to perform the work correctly.
Slotenmaker 24×7's liability for damages due to delayed, incomplete, or improper performance is limited to the amount charged for the relevant work.
Compensation that Locksmith 24x7 may have to pay will never exceed the amount covered by its insurance, except in cases of intent or gross negligence by Locksmith 24x7 or engaged third parties.
Locksmith 24x7 is not liable for damages caused by third parties involved in the job, unless such damages also result from intent or gross negligence on the part of Locksmith 24x7.
The locksmith 24/7 may always attempt to limit or undo the customer's damage, and the customer must fully cooperate with this.
Locksmith 24×7 is not liable for indirect damages, such as consequential damages, lost profits, missed savings, or business interruptions, except in cases of intent or gross negligence. Locksmith 24×7 is also indemnified against damages resulting from illegal actions (such as burglary), criminal actions by the customer or affiliated parties, or incorrect use of materials or goods.
Liability expires after the warranty period has ended or if no warranty has been granted.
Warranty & Liability
All materials and services from Slotenmaker 24×7 come with a 1-year warranty, unless otherwise stated. Deviations from this must be documented in writing on work orders or invoices and signed by the customer.
Locksmith 24x7 guarantees that the supplied materials and goods are free from material, design, or manufacturing defects for 1 year, as indicated on quotes, order confirmations, work orders, delivery documents, or invoices, or for the duration guaranteed by the manufacturer.
In case of defects, Locksmith 24x7 must perform repairs within 30 days of written notification by the customer. This applies to goods delivered or repaired on-site. Other goods must be brought to the office or workshop of Locksmith 24x7. On-site repairs within the warranty are free; after the warranty period, call-out charges may apply.
In case of defects, Locksmith 24/7 can opt for replacement with a suitable alternative, such as a different brand or an improved version.
The customer can only demand replacement or dissolution of the agreement if Locksmith 24×7 has unsuccessfully attempted to repair the same defect three times within the warranty period and this defect is severe enough, or if the customer proves that the goods have so many defects that they do not comply with the agreement.
Locksmith 24/7 is not liable for damages unless they result from intent or gross negligence. The 1-year warranty period applies to normal use.
If materials installed by Locksmith 24×7 fail mechanically within the warranty period, they will be replaced, repaired, or reimbursed up to the original purchase price. This applies only to normal use and not to damage caused by burglary, attempted burglary, or customer-induced damage.
In exceptional cases, such as emergency repairs to locks, doors, or outdated systems, or if the customer insists on installation where Slotenmaker 24×7 cannot guarantee the quality of the existing materials, the warranty does not apply. This will then be clearly stated on the work order or invoice.
Damage from wear and tear of keys of unknown origin is not covered by the warranty. The warranty also becomes void if liquids (such as paint, lubricants, or graphite powder) or solids (such as matches, chewing gum, or glue) enter the goods.
The warranty is void if the customer performs repairs themselves or if maintenance by the customer or third parties leads to defects or damage.
Defects must be reported immediately upon discovery to Slotenmaker 24×7, otherwise Slotenmaker 24×7 is not liable for the consequences.
In case of complaints, the customer must give Locksmith 24×7 the opportunity to inspect the defects. If this does not happen, the customer's rights regarding those defects will expire.
Complaints do not suspend the payment obligation and damages are excluded.
In the case of a valid complaint, the customer can only demand repair or replacement, not compensation.
During a complaint, Locksmith 24/7 may postpone further deliveries until a solution is reached, thereby extending the delivery time.
Complaints about a part of the delivery do not entitle you to cancel the rest of the order.
The customer must prove that the defect arose within the warranty period.
The warranty only starts after full payment of the invoice.
Locksmith 24/7 is not liable for damage during installation due to the condition of the property or hidden structural issues. The customer must fully inform Locksmith 24/7 in writing in advance about the property's construction. In case of insufficient information, Locksmith 24/7 is exempt from liability for any resulting damage.
Locksmith 24×7 is not liable for material or immaterial damage or injury to third parties outside these conditions, unless it can be demonstrated that this is due to gross negligence by Locksmith 24×7 or that they were aware of the defect and should have resolved it.
Locksmith 24/7 is not responsible for defects outside the warranty period.
The customer must inform Slotenmaker 24×7 of problems and give them the opportunity to rectify them within the agreement. Should the customer fail to do so, Slotenmaker 24×7 shall be released from liability for damages.
Confidentiality & Secrecy
24/7 Locksmith handles all security-related work, such as preventing burglary or theft, with strict confidentiality, except in cases of proven criminal offenses (such as in police or legal investigations) or after a court decision, which is considered force majeure.
Locksmith 24x7 is not liable for damage caused by criminal acts or acts against Dutch law, nor for damage caused by orders from the police, judges, or other authorities.
Locksmith 24x7 is relieved of liability for consequential damages or costs due to criminal or illegal actions by third parties, such as unlawful entry by a spouse during a divorce or someone accused of domestic violence.
Slotenmaker 24×7 is not liable for damage caused by criminal or illegal acts, such as opening a door, cabinet, or safe for someone without legal right to do so. Slotenmaker 24×7 is not required to verify the identity of the customer before accepting or carrying out a service (such as opening a door or bicycle lock), unless there is reasonable suspicion of illegality.
When opening doors, cabinets, or safes, or when working in areas with confidential documents, information, or valuables, Locksmith 24/7 is only liable if it is proven that they were aware of the confidentiality or valuables and acted intentionally, resulting in theft or disclosure. The customer must be present during such work, either personally or through a trusted employee. If not, Locksmith 24/7 is indemnified from claims regarding missing, lost, stolen, or absent goods or information.
Quotes, Agreements and Cancellation Fees
Slotenmaker 24×7 quotes are non-binding, unless otherwise stated in writing, and are valid for 1 month. Prices may change due to unforeseen circumstances, such as price increases from suppliers or third parties beyond the control of Slotenmaker 24×7.
Prices in quotes and offers are exclusive of VAT, unless otherwise stated. Extra work outside the signed quote will be charged separately.
Slotenmaker 24x7 is not bound by a quote or order confirmation if the customer should reasonably have recognized that it contained a clear error or mistake.
Orders must be confirmed in writing by the client. If the client does not do so but agrees to the commencement of the work, the quotation terms shall be deemed agreed. Verbal agreements are only binding after written confirmation.
If the customer wishes to give the same assignment to others or has already done so, they must inform Slotenmaker 24×7. Failure to do so will make the customer liable for any costs incurred by Slotenmaker 24×7 (such as wasted trips or non-returnable materials).
Locksmith 24×7 may refuse service without stating a reason.
Agreements regarding assignments, work, services, or ordered goods are binding after a telephone appointment, unless the customer is only requesting information.
No call-out fees are charged for a visit from Slotenmaker 24×7 for installation or advice, unless otherwise indicated in advance. Call-out fees will be charged for false alarms (for example, if the customer resolves the issue themselves or the job turns out to be unnecessary) or for cancellations less than 30 minutes in advance, unless the technician can be recalled, at the discretion of Slotenmaker 24×7.
For multiple visits, a minimum of €50 will be charged. This may vary, for example, for work outside the region or repeated visits, at the discretion of Locksmith 24×7. The customer will be informed about call-out fees where possible.
When purchasing goods or services, Slotenmaker 24×7 may require a deposit of 30 to 50% of the purchase price. The balance must be paid within 14 days of delivery or completion of the work.
